GENERAL ADMINISTRATIVE ORDER NO. 05-04

SUBJECT: ILLINOIS NOT-FOR-PROFIT DISPUTE RESOLUTION ACT

Pursuant to the Illinois Not-For-Profit Dispute Resolution Act (710 ILCS 20/1 et seq.), the Clerk of the Circuit Court of Cook County has collected fees from civil filings for the year 2004 for disbursement to the Dispute Resolution Centers which qualify under said Act and General Order 19 of the Circuit Court of Cook County. Fees available for disbursement from this Fund for the year 2004 total $219,585.00.

Upon review of applications received for funds collected in 2004 the sole qualifying applicant under the requirements set forth in said Act and General Order No. 19 of the Circuit Court of Cook County was found to be Center for Conflict Resolution. It is eligible for the maximum amount allowable for disbursement to any Dispute Resolution Center in a given year of $200,000.00.

Pursuant to the Illinois Not-For-Profit Dispute Resolution Act (710 ILCS 20/1 et seq.), any funds collected but not disbursed in a given year shall be paid in single county judicial circuits to the County Treasurer for the administration of justice in the judicial circuit. An amount of $19,585.00 remains collected for the year 2004 but no Dispute Resolution Center is qualified to receive disbursement of these funds.

Therefore, it is hereby ordered that the amount of $200,000.00, representing the maximum amount allowable for disbursement to any Dispute Resolution Center in a given year, shall be disbursed to Center for Conflict Resolution.

Further, it hereby ordered that the amount of $19,585.00 representing funds collected under the Illinois Not-For-Profit Dispute Resolution Act for 2004 but not disbursed shall be disbursed to the Treasurer of Cook County for the administration of justice in the Circuit Court of Cook County.

IT IS HEREBY ORDERED

Upon receipt of a letter dated May 3, 2005, in which the Director of the Administrative Office of the Illinois Courts has certified the twenty (20) persons receiving the highest number of votes in the election for twenty (20) associate judges of the Circuit Court of Cook County, conducted pursuant to a notice published August 18, 2003, and on which the ballots were mailed April 15, 2005, and returned to the Director on or before April 29, 2005.

I hereby declare the following twenty (20) certified persons to be appointed as Associate Judges of the Circuit Court of Cook County effective June 1, 2005, their terms to expire on June 30, 2007.

IN THE CIRCUIT COURT OF COOK COUNTY, ILLINOIS
 
GENERAL ADMINISTRATIVE ORDER NO. 05-07

SUBJECT: OPENING OF THE 555 WEST HARRISON STREET COURTHOUSE IN THE FIRST MUNICIPAL DISTRICT OF THE CIRCUIT COURT OF COOK COUNTY (AMENDED)

IT IS HEREBY ORDERED General Administrative Order No. 2005-06 is amended as follows:

Effective October 11, 2005, the First Municipal District Courthouse located at 1340 South Michigan Avenue, and Domestic Relations Independent Order of Protection Calendar 72 located at 28 North Clark Street, shall close.

A. All court business formerly conducted at 1340 South Michigan Avenue will be conducted at 555 West Harrison Street, Chicago, Illinois, as follows:

  1. Branch 60, Room 701, Domestic Violence Section, will occupy Room 301.
  2. Branch 61, Room 702, Domestic Violence Section, will occupy Room 401.
  3. Branch 62, Room 601, Domestic Violence Section, will occupy Room 402.
  4. Branch 63, Room 602, Domestic Violence Section, will occupy Room 404.
  5. Branch 64, Room 202, Domestic Violence Section, will occupy Room 302.
  6. Branch 46, Room 501, Assignment/Jury Trial Call/Misdemeanor Section, will occupy Room 304.

B. Branch 47, Room 502, Jury Trial Call/Misdemeanor Section, will close effective October 11, 2005, and all future or pending charges, and any other court business to be scheduled for Branch 47, shall be scheduled for Branch 46 in Room 304. Cases from First Municipal District Branches, Misdemeanor Section, in which jury demands are made, will be transferred to 555 West Harrison Street as follows:

  1. Cases transferred from Branch 34, 155 West 51st Street, Branch 35, 727 East 111th Street, and Branch 43, 3150 West Flournoy, shall be scheduled for their initial appearance in Branch 46 at 9 a.m. seven days after their appearance in Branches 34, 35, and 43.
  2. Cases transferred from Branch 23, 5555 West Grand Avenue, and Branch 29, 2452 West Belmont Avenue, shall be scheduled for an initial court appearance in Branch 46 at 1:30 p.m. seven days after their appearance in Branches 23 and 29.

C. Defendants charged with misdemeanor domestic battery, violation of an order of protection, or other misdemeanors involving a family or household member as defined in 725 ILCS 5/112A-3(3), shall make their initial court appearance in Branch 64 at 10 a.m. for the setting of bail and the scheduling of a future court appearance. The initial court appearance in Branch 64 shall be conducted by way of two-way closed circuit television. All defendants must be transported to 555 West Harrison Street between 5:30 a.m. and 9:30 a.m., Monday through Friday. On weekends or court holidays, defendants shall make their initial court appearance in Central Bond Court (Branch 1) at 2600 South California Avenue.

D. Defendants charged with felony domestic battery, aggravated domestic battery or other felonies, except murder and sex offenses, involving family or household members as defined in 725 ILCS 5/112A-3(3), shall make their initial court appearance in Central Bond Court (Branch 1), 2600 South California Avenue, for the setting of bail. They will then be scheduled for preliminary hearing in Branch 64 at 1:30 p.m. seven days after their arrest date. If that date falls on a weekend or court holiday, then the preliminary hearing shall be held the next regular court business day.

E. Domestic Relations Independent Order of Protection Calendar 72 shall be relocated to Room 202 at 555 West Harrison Street. Further, Domestic Relations Independent Order of Protection Calendar 71 will begin operation and will be located in Room 201 at 555 West Harrison Street.

IN THE CIRCUIT COURT OF COOK COUNTY, ILLINOIS
 
GENERAL ADMINISTRATIVE ORDER NO. 05-08

SUBJECT: CRIME VICTIMS' SERVICES FUND

IT IS HEREBY ORDERED:

Effective December 1, 2005, the Circuit Court of Cook County hereby establishes a Crime Victims' Services Fund. The Crime Victims' Services Fund is established pursuant to sections of the Unified Code of Corrections including 730 ILCS 5/5-5-10, 730 ILCS 5/5-6-3 and 730 ILCS 5/5-6-3.1 to provide services to crime victims and their families. The Crime Victims' Services Fund shall be funded from the collection of probation fees and shall be administered by the Chief Judge or his designee. The amount to be deposited to the fund from the probation fees shall be designated by the Chief Judge or his designee in an amount not to exceed five dollars ($5.00) per month per probation order.

GENERAL ADMINISTRATIVE ORDER NO. 05-09

SUBJECT: STANDARD PROBATION FEE GUIDE

IT IS HEREBY ORDERED:

Effective December 1, 2005, the Circuit Court of Cook County hereby adopts a standard probation fee guide. The standard probation fee guide is established in accordance with the guidelines set by the Administrative Office of the Illinois Courts which provide that the following factors shall be used in assessing an offender’s ability to pay probation supervision fees: the financial status of the offender including, but not limited to, information concerning employment status, number of dependents, other source of income/assets and financial obligations. Information regarding financial status shall be verified, to the extent practicable, by the probation departments.

1. Monthly fee amounts may be adjusted in some cases due to special financial consideration. Such cases require appropriate justification, documentation, and supervisory approval.

2. Income of victims/complaining witnesses (e.g. in domestic violence cases) should not be included.

IN THE CIRCUIT COURT OF COOK COUNTY, ILLINOIS
 
GENERAL ADMINISTRATIVE ORDER NO. 05-10

SUBJECT: ALL CIVIL AND CRIMINAL MATTERS ARISING WITHIN THE MUNICIPALITY OF BENSENVILLE

Pursuant to Subdivision 2.3 (a) of General Order of the Circuit Court Number 1.2, as amended effective January 3, 2006,

IT IS HEREBY ORDERED as follows:

  1. All traffic and misdemeanor matters whether pending or not, to be scheduled for a court appearance on or after January 3, 2006, which arose within the territorial boundaries of the municipality of Bensenville located within the territorial limits of Cook County shall be scheduled for their appearance in the Fourth Municipal District to be heard in a courtroom and on a date designated by the presiding judge of the Fourth Municipal District.
  2. All other matters pending in the Third Municipal District on January 3, 2006, which arose within the territorial limits of the municipality of Bensenville located within the territorial limits of Cook County shall remain in the Third Municipal District until disposed of unless transferred to the Fourth Municipal District by the presiding judge of the Third Municipal District.
  3. All civil and criminal matters arising within the municipality of Bensenville located within the territorial limits of Cook County, on or after January 3, 2006, shall be scheduled for the Fourth Municipal District to be heard in a courtroom and on a date designated by the presiding judge of the Fourth Municipal District.
